Collaborative Compliance Wiki - Terms of Use


This page contains the terms upon which the user may access and use content on the Collaborative Compliance Wiki (the Wiki).


1. Disclaimer


The Wiki has been designed for organisations to share Australian compliance resources and ideas. Its content reflects the views of the authors, and does not represent the views of Jacobson Consulting Pty Ltd .


To the fullest extent permissible by the law, Jacobson Consulting Pty Ltd will not be liable for any direct, indirect or consequential damages arising out of or in relation to the use of the Wiki.


Without limiting the above, this includes (but is not restricted to) loss or damage you might suffer as a result of the following:

(a) any reliance by you on the completeness, accuracy or currency of the Wiki or its content (including third party material on the Wiki). The Wiki is designed for general information only. It should not be regarded as professional advice on the subjects covered on the Wiki;

(b) failure of performance, error, omission, defect, delay in operation or transmission, computer virus, loss of data, communication line failure or unlawful third party conduct;

(c) accessing any sites or servers maintained by other organisations through links on the Wiki. Links are provided for the convenience of our Wiki users only and without responsibility for the content or operation of those sites. Unless otherwise stated, linked sites and their products and services are not endorsed by us and your link to any such site is at your own risk;

(d) any defamatory, threatening, offensive or unlawful conduct of third parties; or

(e) a breach by us of our Privacy Policy (other than a wilful breach).


2. Copyright and Moral Rights


2.1 Licence to others


By posting material onto the Wiki, you license other users of the Wiki to copy, edit and distribute your material, and create derivative works from your material, with or without regard to the integrity of any ensuing works.


2.2 Moral Rights


By posting material on the Wiki you acknowledge that other users may edit your material subject to attribution to the Collaborative Compliance Wiki. To the extent permissible by law, you agree to (i) waive all moral rights; and (ii) consent, with respect to the material posted by you, to the editing and adaptation, and to the non-attribution or false attribution, of that material.


3. User Conduct


3.1 Lawful use


You must not upload, post, transmit or otherwise make available through the Wiki any material which:

(a) violates or infringes the rights of others (including their privacy and publicity rights);

(b) is unlawful, threatening, abusive, defamatory, invasive of privacy, vulgar, obscene, profane, or which may harass or cause distress or inconvenience to, or incite hatred of, any person;

(c) encourages conduct that would constitute a criminal offence, give rise to civil liability or otherwise violate any law;

(d) restricts or inhibits any other user from using or enjoying the Wiki;

(e) affects the functionality or operation of the Wiki or its servers or the functionality or operation of any users' computer systems (for example by transmitting a computer virus or other harmful component, whether or not knowingly); or

(f) breaches any standards, content requirements or codes of any relevant authority, including authorities which require us to take remedial action under any applicable industry code.


3.2 Blocking user access


If you breach any of these Terms of Use, Jacobson Consulting Pty Ltd has the right to block your access to the Wiki, and to refuse to allow you to have access to the Wiki in future.


3.3 Infringement of others' proprietary rights


You must not, without the express permission of the relevant rights owner, upload, post, transmit or otherwise make available through the Wiki any material protected by copyright, trade mark or other proprietary rights.The hosting service provider for the Wiki may disable access to any material which infringes copyright law.


3.4 Monitoring Wiki content


If you submit material to the Wiki you permit us, for any reason, to:

(a) monitor the content of the Wiki to determine compliance with these conditions; and

(b) edit or remove any material submitted by you.

However, we do not assume any obligation to monitor or censor this material.



4. Indemnity


You agree to indemnify and will keep Jacobson Consulting Pty Ltd indemnified for any claim, demand, injury, direct or indirect damage, loss or cost, liability, right of action or claim for compensation in contract, under statute or in tort (including negligence) made against or suffered by Jacobson Consulting Pty Ltd in connection with your use of the Wiki

or your breach of these Terms of Use.


5. Privacy


If you provide us with your email address, we will record your email address, but will only use it for the purpose for which it was provided. It shall not be disclosed without your consent.


Because we respect your right to privacy, we do not sell or rent any personal information gathered.


No data collected from this site will be disclosed to a third party without your consent, except where we are legally compelled to do so.


When you log in you will be asked for your username and password.


If you edit a page, your username will be recorded and displayed as the editor.


6. Acceptance of Terms of Use


(a) You agree to be bound by these Terms of Use.

(b) These Terms of Use are subject to change from time to time at the sole discretion of Jacobson Consulting Pty Ltd. You should read the Wiki’s terms of use page regularly to ensure you are updated as to any changes.

(c) These Terms of Use shall be governed by the laws of the state of Queensland, Australia. The parties agree to submit to the exclusive jurisdiction of the courts exercising jurisdiction there.
